In addition to the federal and state tax issues addressed in prior sessions, this session will focus on tax issues with which many flight department managers become familiar only after they are deeply involved in a tax audit. Group participants will learn how to identify key issues related to passive activity loss limitations and hobby loss rules, which could severely affect aircraft utilization or timing of losses in connection with business aircraft, what constitutes “ordinary and necessary use”, and reducing overall audit exposure. Our presenters will also use their experiences in representing aircraft owners and operators involved in tax audits to help participants better plan their operations to avoid passive loss limitations.

Flight crews will appreciate your proactive assistance.
Do you need to be a pilot to be a good scheduler/dispatcher? The most effective schedulers and dispatchers do not have to be aviators, but they all need to have a thorough understanding of basic aircraft performance and limitations so that they can help ensure the safety of their crew and passengers. This session will teach you the basic information you need to understand your aircraft, such as: aerodynamics; control surfaces; take-off, cruise and landing performance and limitations; and aircraft stability (weight and balance).
Hindsight is 20/20. Would you do anything differently if faced with the same situation again? Is there a better way to handle routine tasks? Many of the problems encountered by flight crews and aircraft dispatchers have very little to do with the technical aspects of flight operations. Instead, most are associated with poor group decision-making, ineffective communication, inadequate leadership, and poor task or resource management. Historically, aircraft dispatcher training programs have focused almost exclusively on the "how to" aspects of dispatching and on an individual dispatcher's performance; these programs did not effectively address resource management issues fundamental to safe flight. The FAA's newly proposed limitation ignores the legitimate need for the Block Aircraft Registration Request (BARR) Program, and runs directly counter to long-established assumptions about government's role in the protection of privacy. Among the concerns held by NBAA and its Members are the following:
The proposal is fundamentally inconsistent with government’s long-established obligation to protect privacy, not to compromise it.
The FAA has failed to advance any affirmative public policy rationale for the proposal; the agency doesn't explain what problem it is trying to solve.
The proposed requirement to prove a “Valid Security Concern” establishes an unjustifiably high bar even to individuals and companies that do have legitimate security concerns.
The proposal utterly fails to acknowledge the vital interest that companies may have, beyond traditional notions of privacy, in blocking public access to information about their corporate flights.
The proposal, if implemented, would create a huge administrative burden to both operators/owners and the FAA without offering any discernible benefit.

Although not a particularly complex destination, there are specific operational requirements, regulations and potential "gotchas" that flightcrews and schedulers need to be aware of well before engine start. This week will provide an overview of the European operational environment as well as detailed information on such topics as EU importation, eBorders and the 2012 Olympics in London.
While more trips are being scheduled to Africa, it remains a region that is still difficult to communicate with and requires significant pre-planning. In addition, the Middle East continues to experience political unrest and security concerns. This week will focus on current operational issues and will define what you need to know from those who fly and operate in this extensive region.
This week’s review of the North Atlantic/North American region will include a discussion of Canadian and North Atlantic operational procedures and equipment requirements and will review current U.S./Canada border issues with the focus on cabotage and CANPASS.
The focus for this week will feature expertise on flight planning in the Pacific Rim region from both pilot and handling perspectives, with an emphasis on India. These rules changed significantly in 2004 and continue to evolve. The World Health Organization (WHO) defines the H1N1 pandemic (aka "swine flu") as a worldwide epidemic of a disease. According to the WHO website, H1N1 has been classified as being of moderate severity. "Moderate" indicates the pandemic's global impact, not the impact country-by-country. As such, it should be emphasized that countries may be affected differently – different levels of impact, different timing of outbreaks, different impacts on the economies and health systems. It is important that countries should calibrate their response based on the likely impact in their country.
Companies that utilize or support Business Aircraft must also prepare their response should they be impacted by H1N1. The reasons are obvious as aircraft provide confined meeting spaces for a duration of time; FBO’s allow a venue for many people to arrive, interact, and depart through their facilities both airside and curbside; and global economies allow for international travel to areas where the H1N1 impact may vary in severity.
FAR 91.501 gives large jet operators the flexibility to use timesharing, interchange, joint ownership and other methods, such as monetary charge-backs, to meet business demands with their aircraft without operating the aircraft under FAR Part 135. FAR 91.501 does not give these regulatory advantages to small airplane or helicopter operators. NBAA addressed this problem decades ago by obtaining an exemption for NBAA Members who operate small airplanes and/or helicopters. This Session explains the advantages of timesharing, interchange, joint ownership and other options for NBAA Members who wish to use the NBAA Small Aircraft Exemption and how to comply with the specific requirements of the Exemption.

Pilots require two certificates from the FAA to fly: a pilot certificate and a medical certificate. The criteria for maintaining the pilot certificate are well defined. In contrast, the FAA does not publish specific criteria for maintaining one's medical certificate. Significant FAA medical policy decisions are made frequently and enforced strictly, but are usually unknown to pilots and even to aviation medical examiners. Ignorance of these unannounced changes may cause pilots to lose medical certificates for months or may even unnecessarily jeopardize a career. This presentation addresses recent FAA medical policy and standards changes (both favorable and unfavorable), look at pending changes and discuss strategies to avoid FAA enforcement actions for medical reporting infractions. Subject areas include cardiac health, vision, hearing, cancer, depression, alcohol related incidents, medications and more. The World Health Organization (WHO) defines the H1N1 pandemic (aka "swine flu") as a worldwide epidemic of a disease. According to the WHO website, H1N1 has been classified as being of moderate severity. "Moderate" indicates the pandemic's global impact, not the impact country-by-country. As such, it should be emphasized that countries may be affected differently – different levels of impact, different timing of outbreaks, different impacts on the economies and health systems. It is important that countries should calibrate their response based on the likely impact in their country.
Companies that utilize or support Business Aircraft must also prepare their response should they be impacted by H1N1. The reasons are obvious as aircraft provide confined meeting spaces for a duration of time; FBO’s allow a venue for many people to arrive, interact, and depart through their facilities both airside and curbside; and global economies allow for international travel to areas where the H1N1 impact may vary in severity.

Through the use of Safety Management Systems (SMS), business aircraft operators can proactively identify and manage risks. The International Civil Aviation Organization (ICAO) Standards and Recommended Practices (SARPS) found in Annex 6, Part 2 specify that a SMS is required for operators of non-commercial aircraft over 12,500 pounds or turbojet powered aircraft. The effective date for ICAO member states (countries) to begin implementation of these standards is November 2010. Effective on January 1, 2009, the ICAO standards applicable to commercial operators required member states to include in their state safety program the requirement for commercial operators to implement a SMS. While the FAA has yet to issue any SMS regulations for U.S. registered operators, NBAA is confident that any future regulations will be based on ICAO SARPS.
